1. Agreement
By accessing smartpropai.life (the "Site"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Site. These Terms supplement any written engagement letter or master services agreement between you and SmartProp AI Inc. ("SmartProp AI", "we", "us") for paid analytics services. Where a signed contract conflicts with these Terms regarding paid services, the contract prevails.
2. Operator
The Site is operated by SmartProp AI Inc., a corporation incorporated in British Columbia, Canada, with registered office at 525 Seymour Street, Suite 105, Vancouver, BC V6B 3H7. Business Number: BN 359 742 810 RC0001. Contact: [email protected].
3. Brand and domain clarifications
smartpropai.life: The .life top-level domain is used for branding purposes only. SmartProp AI is not a lifestyle, wellness, coaching or personal-development brand.
"Smart": In our name and materials, "Smart" refers to AI and data intelligence applied to property and real-estate decisions. It does not refer to smart-home Internet-of-Things devices, home automation gadgets, "smart contracts", cryptocurrency, tokenized real estate, real-estate NFTs or blockchain property platforms.
"Prop": Means property and real estate. It does not refer to theatrical stage props, aviation propellers, informal "props" (recognition), or sports-betting "player props".
What we are: An AI-driven real-estate analytics and intelligence studio delivering market intelligence, forecasting, portfolio analytics, geospatial insight and decision support on engagement.
What we are not: A licensed real-estate brokerage or agent, a property listings portal or marketplace, a mortgage lender or broker, an investment dealer or fund, an iBuyer, a property-flipping business, a real-estate-investing course or "passive income" programme, a self-serve SaaS product, a smart-home vendor, or a data broker selling leads.
4. Nature of information on the Site
Content on the Site is provided for general information about our analytics studio services. It does not constitute investment, financial, legal, tax, real-estate or professional appraisal advice. Any valuations, prices, forecasts, scores, rents, illustrative metrics or case references described on the Site are model-generated estimates or hypothetical examples for information only — not guarantees of future performance.
Analytics inform property decisions; they do not replace your independent judgment, accredited appraisals where required, or advice from qualified professionals. The decision stays with you. We do not guarantee any price, rent, appreciation, return, sale, occupancy or business outcome. Results depend on market conditions, data quality and factors outside our control.
Illustrative engagement descriptions and metric ranges on the Site are not promises of results for future clients. Past project types do not predict future performance.
5. No professional advisory relationship
Browsing the Site or submitting a contact form does not create a client, advisory, fiduciary or brokerage relationship. A engagement begins only when both parties execute a written scope document. SmartProp AI does not act as your agent in any real-estate transaction.
6. Acceptable use
You agree not to:
- Use the Site unlawfully or in a manner that could damage, disable or impair it;
- Attempt unauthorized access to our systems, other users' data or non-public areas;
- Scrape, harvest or automate extraction of Site content without written permission;
- Misrepresent affiliation with SmartProp AI or imply endorsement without consent;
- Upload malware, spam or harmful code through forms or other inputs;
- Use Site content to imply guaranteed investment returns or market predictions we do not make.
7. Intellectual property
Site content — text, design, logos, graphics, layout and compilation — is owned by SmartProp AI or its licensors and protected by Canadian and international intellectual property laws. You may view and print pages for personal, non-commercial reference. You may not reproduce, distribute, modify, create derivative works from, or publicly display Site content for commercial purposes without prior written consent, except as permitted by fair dealing or fair use.
The SmartProp AI name, Terrain design elements and associated marks may not be used in a manner likely to cause confusion without authorization.
8. Third-party links
The Site may link to third-party websites (e.g., privacy regulators, mapping resources). We do not control and are not responsible for third-party content or practices. Access linked sites at your own risk and review their terms and privacy policies.
9. Privacy and cookies
Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain how we handle personal information under PIPEDA and, where applicable, BC's Personal Information Protection Act (PIPA BC).
10. Disclaimer of warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the fullest extent permitted by applicable law. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
11. Limitation of liability
To the fullest extent permitted by British Columbia law, SmartProp AI Inc. and its directors, officers, employees and contractors shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunities, arising from or related to your use of the Site, even if advised of the possibility of such damages.
Our aggregate liability for direct damages arising from Site use (excluding paid services covered by a separate contract) shall not exceed one hundred Canadian dollars (C$100). Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the minimum permitted by law.
12. Indemnity
You agree to indemnify and hold harmless SmartProp AI from claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site, except to the extent caused by our gross negligence or wilful misconduct.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You attorn to the exclusive jurisdiction of the courts of British Columbia sitting in Vancouver for disputes arising from these Terms or Site use, subject to any consumer protection rights that cannot be waived in your jurisdiction.
14. Changes
We may revise these Terms at any time. The updated version will be posted with a revised "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms. Material changes may be highlighted on the Site.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
